CLEARWAY WASTE MANAGEMENT - Safety Disposal Agreement

1. Introduction

By booking a service with Clearway Waste Management ("We", "Our", "The Company"), you ("You", "The Client") agree to the terms and conditions outlined in this Safety Disposal Agreement regarding the collection, disposal, and handling of waste materials. Our goal is to provide a safe, efficient, and responsible service while ensuring compliance with relevant UK regulations.


2. Client’s Responsibilities

As part of the booking process, you agree to the following:

  • Accurate Waste Information: You agree to provide a clear and accurate description of all waste to be collected, including any large, heavy, or special items (e.g., fridges, freezers, sofas, mattresses, etc.).
  • Undisclosed Waste: If any waste differs from what was described (such as hazardous or large items not mentioned), Clearway Waste Management reserves the right to charge extra for the removal of such waste.
  • Access: You will ensure that our team has safe, clear, and unrestricted access to the property for waste collection.


3. Additional Charges

Certain items or conditions may incur extra charges:

  • £30 Charge Per Item: If we discover the following items during the collection that were not initially mentioned, there will be an additional £30 charge per item:

  • Fridges
  • Freezers
  • Mattresses
  • Sofas
  • Exceeding Free Labour Time: For collections that exceed the time allocated (e.g., more than 60 minutes for up to 1200 kg of waste), you agree to pay an additional £50 per hour for every extra hour spent on site.

  • Excess Weight Charges: If the weight of the waste exceeds the agreed limit (e.g., over 1200 kg), you will be charged extra based on the additional weight. Our team will provide a weight estimate and discuss the surcharge before proceeding.


4. Items We Cannot Collect

For safety reasons and legal compliance, we cannot collect certain items. The following materials must not be included in the waste collection:

  • Asbestos
  • Human waste
  • Chemical waste
  • Biological waste
  • Radioactive materials
  • Animal waste
  • Fuel (petrol, diesel, etc.)
  • Paints, oils, creosote, solvents
  • Gas bottles or compressed cylinders
  • Tyres

If any of the above items are discovered during collection, we reserve the right to refuse the collection or charge an additional fee for special disposal of these materials.


5. Liability and Responsibility

  • Proper Disposal: We ensure that all waste collected will be disposed of in compliance with UK environmental laws and regulations. However, if undisclosed or prohibited materials are found, Clearway Waste Management will not be held responsible for any consequences arising from improper disposal.

  • Damage or Injury: We are fully insured for any damage or injury caused during the waste collection process. However, any damages or injuries resulting from undisclosed hazardous materials or incorrect packaging are the responsibility of the client.


6. Payment Terms

  • Initial Estimate: The cost for the waste collection will be provided as an estimate during the booking process and will depend on the volume, type of waste, and any additional services required.

  • Additional Charges: Any additional charges, such as extra fees for heavy or hazardous items, will be confirmed before work commences. If such items are found during the work, you will be notified, and these charges will be added to the final invoice.

  • Full Payment Due: Full payment is due upon completion of the service. Invoices must be paid on the same or the next working day. We will not provide transfer notices or confirmation of disposal until full payment has been made.

  • Payment Methods: Payment can be made via bank transfer or cash. If payment is not received within the agreed time, we reserve the right to charge additional fees or suspend further services.


7. Agreement Acknowledgement

By confirming your booking, you acknowledge and agree to the terms outlined in this Safety Disposal Agreement, including all additional charges for undisclosed waste, excess weight, or prohibited materials. You also agree to cover any extra fees for work that exceeds the standard time allocation.

8. Client Consent

By booking our services, you confirm that you have read, understood, and accepted the terms of this Safety Disposal Agreement. This includes the accurate description of waste materials, additional charges for undisclosed or prohibited items, and extra fees for any work that exceeds the time or weight limits.
